During my 3L year at Emory University School of Law, I proudly served as president of the Emory Public Interest Committee. Though my path ultimately led me to private practice, community and pro bono service remain a critical component of my career. Last Sunday, I was honored to receive Fisher Phillips' inaugural Pro Bono Impact Award. This award is given to "An attorney who has gone above and beyond to provide outstanding pro bono representation to disadvantaged individuals and/or organizations that serve our communities.This attorney's commitment to pro bono work exemplifies FP's dedication to providing access to justice for our neighbors in need."If this award is due to anything, it is embracing the idea that impactful pro bono work can be done in manageable chunks. Last year, I worked with Corey J. Goerdt and Atlanta Legal Aid Society to train interested FP Atlanta colleagues on how to handle cases for ALAS's Gender-Affirming Name Change Project. Since then, FP Atlanta has handled over a dozen name change matters and is taking on more all the time. These cases take less than ten hours (if that) over (at most) 2-3 months, but you cannot imagine how meaningful it is to help a pro bono client be legally recognized by the name that matches their identity.If you are someone who hasn't done pro bono work in a while because you can't find the time to do something, remember that doing just a SMALL something is better than nothing and that a lot of small somethings can add up quickly. It's a weird and exciting time for employee defection and trade secrets attorneys. If you haven't gotten around to reading all 570 pages of the FTC's Non-Compete Clause Rule and you are wondering what has happened, what has not happened, what MAY happen, and what you should do about it (if anything), this is the article for you. The Fisher Phillips Employee Defection and Trade Secrets team in Atlanta watched the FTC's live webcast yesterday during which the Commission publicly disclosed and voted to approve its final rule banning non-competes. The Final Rule contains some welcome concessions compared to what was originally proposed (for example, the FTC significantly expanded the sale-of-a-business exception), but is still much more aggressive than most state schemes (for example, the Final Rule will be retroactively applied to all except "senior executives" and employers are required to provide notice that their current non-competes are unenforceable to affected workers). One challenge has already been filed in the Northern District of Texas and the U.S. Chamber of Commerce has said it plans to sue the FTC as early as today.

Next week is sure to be interesting in the world of noncompetes! Yesterday, the FTC announced that it will be holding a virtual, special open committee meeting on Tuesday, April 23, to decide whether to issue a final version of the noncompete rule it initially proposed in January of 2023. The procedure for voting on the rule (which actually involves multiple rounds of voting on things like “whether to authorize public disclosure of the proposed final rule that is under consideration” before turning to a vote on the rule itself) suggests that the final rule being considered is at least somewhat different than the near total ban we saw over 15 months ago.

Both a personal and professional update: Today, I am returning to the office after 16 weeks of maternity leave. Jeremy Ames Frisch arrived October 2, 2023. He has been the most easygoing guy and has a smile that is sure to melt your heart. I am so grateful to Fisher Phillips for the time I had to heal, bond with my baby, and transition into life as a family of four. Being a lawyer makes me a better mom and being a mom makes me a better lawyer. Looking forward to reconnecting with my colleagues and clients!
